Yesterday’s hearing on the Misinformation and Disinformation Bill featured testimony from The Victorian Bar, the Human Rights Law Centre, and legal expert Professor Anne Twomey. I asked whether the Bill was flawed—namely, the idea that social media platforms should be allowed to decide and censor misinformation. This will likely involve the use of fact-checkers, many of whom are funded by lobby groups and have flawed processes. Professor Twomey’s testimony on this was particularly interesting, given her frequent interaction with these "fact checkers."
This Bill puts the "dingo in charge of the creche." Meanwhile, public servants at Australian Communications and Media Authority (ACMA) will be in a position to step in as referees when the platforms fail. However, they lack the expertise to determine what is true and what is not, and will most likely use the same fact-checkers out of necessity.
All witnesses agreed that the process is flawed, that more transparency is needed, and that a code is required to impose a duty of care on the platforms.
